The instant bail application under Section 483 B.N.S.S. has been filed by the petitioner in connection with the FIR No.191/2025 registered at Police Station Jawahar Nagar (Kota City), District Kota City, wherein he has been charged for the offences punishable under Section 80(2) of BNS, 2023. 2. Learned counsel for the petitioner submits that after investigation, charge-sheet has been submitted against the petitioner under Section 80(2) and 108 BNS. Counsel submits that after framing of the charges against the petitioner for the above offences, the statements of the complainant PW-1 Sunil Kumar, who is the father of the deceased and PW-2 Ravita, who is the (2 of 3) [CRLMB-15700/2025] mother of the deceased have been recorded. They have not supported the version of prosecution, hence, they have been declared as hostile. Counsel submits that the petitioner has been in custody since 16.10.2025 and the investigation/trial will take its own time to conclude, therefore, indulgence of bail may be granted to the petitioner. 3. Per contra, learned Public Prosecutor opposed the bail application, but the counsel appearing on behalf of the complainant has supported the arguments raised by counsel for the petitioner. 4. Heard and considered the submissions made at Bar and perused the material available on record. 5. Considering the arguments put forward by counsel for the petitioner and looking to the fact that the parents of the deceased, i.e., PW-1 Sunil Kumar and PW-2 Ravita have not supported the allegations and version of the prosecution against the petitioner and have declared as hostile and also looking to the fact that the petitioner has been in custody since 16.10.2025 and the trial will take its own time to conclude, without expressing any opinion on merits of the case, this Court deems it just and appropriate to grant indulgence of bail to the petitioner under Section 483 BNSS. 6. Accordingly, this bail application under Section 483 B.N.S.S. is allowed and it is ordered that the accused-petitioner Ashwin Jain Alias Bittu S/o Jinendra Jain arrested in connection with the aforementioned FIR, may be released on bail; provided he furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of the learned Trial Court with (3 of 3) [CRLMB-15700/2025] the stipulation to appear before that Court on all dates of hearing, as and when called upon to do so.
