1. The petitioners have preferred this writ petition under Article 226 of the Constitution of India, seeking following relief(s):- 10.1 The Hon’ble Court may kindly be pleased to issue a writ in the nature of mandamus or suitable direction to the BINI PRADEEP Digitally signed by BINI PRADEEP Date: 2025.08.01 14:08:56 +0530
2 respondents for grant of higher pension under the provision of EPS, 1995 in view of the notification Annexure-P/1 colly. 10.2 The Hon’ble Court may kindly be pleased to allow the consequential benefits and arrears from the date when they are entitled to get the benefits of higher pension. 10.3 May kindly be pleased to allow any other relief as the Hon’ble Court may be deemed fit and proper. 10.4 Cost of the petition may also be given.

At the outset, learned counsel for the petitioners submits that in pursuance of the judgment dated 04.11.2022 (Annexure-A/1) rendered by Hon’ble Apex Court in the case of The Employees Provident Fund Organisation & Anr. Etc. vs. Sunil Kumar B. & Ors. Etc. and other connected cases, arising out of Special Leave Petition (C) Nos. 8658-8659 of 2019, the petitioners want to file fresh representation before the respondent authorities in the changed circumstances erupt from the aforesaid
judgment. Therefore, she seeks permission of the Court to withdraw this petition with liberty to file representation before the respondent/competent authority for redressal of their grievance.

Learned counsel for the respondents has no objection in allowing the limited prayer of the petitioners.
4. On due consideration, the prayer is allowed and the petitioners are permitted to withdraw this petition with liberty to file representation before the respondent authorities in the light of judgment rendered by the Apex Court in the case of The Employees Provident Fund Organisation (supra).
