ORDER: The Cr-lminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brev'lty fthe BNSS]), seeking to enlarge the petitioner/Accused No.1 on bail in Cr.No.55 of 2024 of G.Madugula police station, Alluri Sitharama Raju District, registered against the petitioner/Accused No.1 herein for the Offence Punishable under Section 8(c) r/w 20(b)(ii)(c) of Narcot®lc Drugs and Psychotropic Substances Act, 1985 -<=-A t=--=+ ---=-=\

The case of the prosecution isthat on 13.12.2024, the S.I. ofG.Madugula Police Station, on receipt of information, apprehended the accused While in possession and transporting 200kgs of ganja and seized the contraband under the cover of mediators report and arrested him and sent him to judicial custody. 3. Heard, learned counsel for the petitioner and the learned Assistant Public prosecutor.`' perused the record. 4. Sri G.Maheswara Rao, learned counsel for the petitioner submits that the petitioner has not committed any offence; petitioner is innocent; petitioner was falsely implicated; he would abide by any conditions to be imposed by this Court; and urged to enlarge the petitioner on bail. 5. On the other hand, Sri Neelotphal Ganji, learned Assistant Public Prosecutor, argued that 200 kgs of ganja were found in the possession Of the petitioner; the investigation is underway and he urged the Court to pass appropriate orders. 6. On perusal of the record, the petitionerwas arrested on 13.12.2024, ever since he has been in the judicial custody. 7. 'ln view of the nature of the allegations leveled against the petitioner in the complaint, the specific role played by the petitioner, stage Of investigation and the period c}f detention undergone by him in judicial custody, this Court is inclined to enlarge the petitioner on bail with strict conditions. 8. In the result, the criminal petition is allowed with th; following conditions: ---+ SEE i=E
i) The petitioner/accused No.1 shall be enlarged on bail subject to the executing a bond for a sum of Rs.50,000/- (Rupees fifty thousand only), with two sureties each for the like sum each to the satisfaction of the learned I Additional District & Sessions Judge-Gum-Special Judge of Offences under NDPS Act, Visakhapatnam. ii) The petitioner/accused No.1 shall appear before the Station House Officer, G.Madugula Police Station, AIluri Sitharama Raju District, on Saturday once in two weeks in between 10:00 am and o5:00 pm., till the conclusion of the Trial.
