Criminal Miscellaneous Bail Application No. 15397/2025 Ramlakhan @ Golu S/o Birdhilal, Aged About 32 Years, R/o Khuri, Police Station Atru, District Baran (Baran) (At Present In District Jail, Baran) ----Petitioner Versus State of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr Jagdish Singh Chauhan For Respondent(s) : Mr. Vivek Sharma, PP HON'BLE MR. JUSTICE SANDEEP TANEJA
Order 18/02/2026
1. This bail application has been filed on behalf of the accused- petitioner under Section 483 of B.N.S.S. in connection with FIR No. 310/2025 registered at Police Station Atru, District Baran for offences under Sections 103(1), 3(5) of B.N.S., however, after investigation, the Investigating Agency has found that the offence under Section 108 of B.N.S is made out against the petitioner.
2.
Learned counsel for the petitioner submits that the petitioner, who is an innocent person, has been falsely implicated in this case and he has nothing to do with the alleged offence.
Learned counsel further submits that the petitioner and deceased got married ten years ago and were living happily. Learned counsel also submits that no instigation was ever made on the part of the petitioner to the deceased to commit suicide. He further submits that the petitioner is in custody since long;
(2 of 2) [CRLMB-15397/2025] charge-sheet has been filed in the matter; no recovery is required to be made from him; the statements of the complainant and other material witnesses have already been recorded and trial of the case will take considerably long time in its conclusion, so no fruitful purpose would be served by keeping him in custody, therefore, he prays to enlarge the petitioner on bail.
3. Per contra, learned Public Prosecutor vehemently opposes the submissions made by learned counsel for the petitioner hereinabove.
4. Taking into consideration the overall facts and circumstances of the case; the arguments advanced by both the parties and the
facts that charge-sheet has already been filed in the matter, material witnesses have been examined and trial will take considerably long time in its conclusion, thus, without commenting anything on merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.
5. Therefore, the bail application under Section 483 B.N.S.S. is allowed and the accused-petitioner, namely Ramlakhan @ Golu S/o Birdhilal, is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs. 1,00,000/- with two sureties of Rs. 50,000/- each to the satisfaction of the trial Court, with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
