The petitioner by filing this application under Article 226 of the Constitution prays to remove the proclamation form issued under Section 82 of the Code of Criminal Procedure, which has been affixed in the outer wall of the petitioner’s house, in connection with Bankmore P.S. Case No.138/2023.

Learned counsel for the petitioner submits that neither the petitioner nor his family members are related with the accused against whom the proclamation has been issued. The respondents’ police have committed grave illegality by affixing the notice in the house of this petitioner. The petitioner is thus now being defamed and shamed.

After hearing the petitioner, I find that it is the grievance of the petitioner that a proclamation notice issued in the name of Saifi @ Saif Abbas Nakwi @ Shafi has been affixed in the outer wall of house of this petitioner. The petitioner has claimed that he has got no relation with the said accused. Neither the accused is known to him nor the accused resides in the house of this petitioner. affixed the said notice in the house of this petitioner which is defaming the petitioner.

Considering the nature of relief sought for, I direct the petitioner to appear before the concerned Court and file an appropriate application, as to determine the correction of the submission of the petitioner. If the petitioner files any application before the concerned Court, the Court will consider the case of the petitioner after seeking an appropriate report from the I.O. and other Police Official and will pass an appropriate order on the said claim.

The petitioner also claims damages for the wrong done by the respondents. Damages also cannot be granted by this Court, as the same needs proper evidence in its support. Further loss caused to this petitioner cannot be assessed by this Court exercising jurisdiction under Article 226 of the Constitution.

With the aforesaid observation, this criminal writ petition stands disposed of.
