Pleader for RR 1 to 3 * * * * * ORDER (Order of the Court was made by the Hon'ble Chief Justice) In response to the allegation of inaction on the complaint regarding encroachment on a waterbody in Survey No.294/4, Nambiyampalayam Village, Avinashi Taluk, Tiruppur District, learned State counsel, on advance instructions, would submit that taking cognizance of the complaint, a survey was conducted on 13.10.2025 by the Revenue Inspector and on S.No.294/4 as well as S.No.293, encroachment on State Highways as well as waterbody has been found, whereafter memo has been sent on 17.10.2025 through the competent officers of Water Resources Department as well as State Highways for taking action. In view of what has been stated by the learned State counsel and on perusal of letter dated 17.10.2025 addressed to the State counsel by the Tahsildar concerned, we are of the view that the present is not a case of any inaction on the part of the respondents. As action has already been initiated, we are not inclined to keep this petition pending, but to dispose of the matter with a direction that the proceedings at both the levels in the Department of State Highways and Water Resources should be concluded as early as possible, preferably within a period of four months, of course, after giving opportunity of hearing to the persons who have encroached upon State Highways and waterbody. Petition is, accordingly, disposed of. There shall be no order as to costs.
