ELEVATED AS JUDGE The Court made the following: ORDER This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- “…. to issue a Writ, Order or Direction,more Particularly one in the nature of Writ of Mandamus declaring the proceedings issued by the 2 4th respondent vide Rc.No.B1/165/2017, dated 06.05.2017 as illegal and consequently set aside the proceedings issued by the 4th respondent vide Rc.No.B1/165/2017, dated 06.05.2017 and pass such …..” 2. The case of the petitioners in brief is that the 2nd petitioner temple is an old temple which has been in existence for over 400 years. The fore fathers of the first petitioner were doing Archakatvam in that temple, later the first petitioner is doing the same. While things stood thus, orders have been passed for adoption of 2nd petitioner temple vide Dis No.B1/37498/91, dated 24.09.1992 giving a direction to the Assistant Commissioner of the 4th respondent temple to take complete charge of the 2nd petitioner temple. The said orders were challenged on various grounds. Later on 28.04.2017, the 3rd respondent issued proceedings vide Rc.No.A1/2520/2017, dated 28.04.2017 directing the Executive Officer of 4th respondent temple to take charge of the management of 2nd petitioner temple from the present person immediately in the presence of Inspector, Endowments Department, Amalapuram. Subsequently, the 4th respondent issued a paper publication on 06.05.2017 in Sakshi News paper in local Edition, East Godavari District, stating that they are going to conduct public auction for lease hold rights of 2ndpetitioner temple lands. Hence the present writ petition is filed. 3. Heard the learned counsel appearing for the petitioners and the learned Government Pleader for Endowments appearing for the respondents. 3 4. On hearing, both the counsels submit that the lease period is for 3 years i.e., from 2017 to 2020 and the said lease period is expired in the year 2020 itself.In view of the same, nothing survives in the present writ petition for further adjudication at this stage and the same may be closed. 5. Recording the above submissions, this Writ Petition is closed. No order as to costs. As a sequel, miscellaneous applications pending, if any, shall also stand closed. _________________________ DR. K.
