GOLLAPALLI MAHESWARA RAO COUNSEL FOR THE RESPONDENT : PUBLIC PROSECUTOR THE COURT MADE THE FOLLOWING ORDER HON'BLE SRI JUSTICE KI SREENIVASA REDDY Criminal Petition NoI5951 of 2025 Order: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioners/Al and A2, seeking regular bail, in Crime No.41 of 2025 of Paderu Police Station, Alluri Sitharama Raju District. 2. A case has been registered against the petitioners herein and another for the offences punishable under Sections 20(b)(ii)(B), 25 r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985- 3. Case of the prosecution, in brief, is that on 26.05.2025 at 12.00 hours, on credible information about illegal transportation of ganJ'a, Sub-Inspector of Police, Paderu Police Station, along with his staff and mediators, proceeded to Bokke'lu Junction, Bokkellu Village and while conducting vehicle checking, found Al and A2 in possession of O3 Kgs of ganja which is purchased from A3. Al and A2 are arrested and remanded to judicial custody on 26,05.2025 and contraband was seized under'the cover of mediators report. 4. Learned counsel for the petitioner submits that the quantity of Ganja allegedly seized from the possession of the petitioners herein is not a commercial quantity and material part of the investigation is completed. _1_-- --- 8 \`rs \`t i-i . € 5. on the contrary, learned Assistant public Prosecutor opposed the petition on the gro-und that the invest[-gation is not completed. 6. Heard. perusedtherecord. 7. The petitioners were arrested and sent to judicial custody on 26.05,2025 and since then they are languishing in jail. The quantity of Ganja allegedly seized from the possession of the accused is 3 Kgs, which does not amount to commercial quantity. In view of the aforesaid facts and cI-rCumstances of the case, request of the Petitioner can be considered for bail. 8. Accordingly, the criminal petjtjon I-S allowed, The petitioners shall be released on bail on each of them executing a personal bond for Rs.10,000/-(Rupees Ten Thousand only) with two sureties for the like sum each, to the satisfaction of the learned I Addl'tional District & sessions Judge, Visakhapatnam. The pet1'tiOnerS Shall appear before the station House Officer concerned on every sunday between 10.00 AM and 1.00 PM till filing of the charge sheet.
