PETITIONNO: 6172 OF 2025 This CrI|minal Petition, under sections 480 and 483 of the Bharatjya Nagarik suraksha sanhita, 2023, has been filed by the petitioner/A1, seeking bail in Crime No.244/2023 of New Port Police Station, visakhapatnam commissI|Onerate. 2. A case has been registered agaI-nSt the petI-tiOner and others for the offences under sections 20(b)(ji)(B) read with 8(c) of the Narcotic Drugs and psychotropic substances Act

Case of the prosecution, in brief, is that on 22.12.2023, on credible jnformatjon regarding illegal possession and transportation of ganja, the s.I of Police, New Port Police Station, along with staff, rushed to GadI-ya Structural Private LI'mited, Vacant place in JP yard, Pedagantyada and found Al to A4 while they were in possession of 5.5 kgs of Ganja. On interrogation, they disclosed their identity particulars. The contraband, along with other material, was seized under the cover of medl'ators report and the accused were arrested on the same day i.e. on 22.12.2023 and since then he is in judicial remand. 4. Heard learned counsel for the petitioner and learned Assistant Public Prosecutor. perused the record. 5. 6. The petitioner was arrested on 22.12.2023 and since then he is languishing in jail.
Police have not completed the investigation and not filed the charge sheet. As such the petitioner is entitled for default bail as per Section 187 of B.N.S,S.
7. ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner herein, on the following conditI.OnS. (i) The petitioner/Al herein shall be released on his executing a Personal bond for Rs.10,000/-(Rupees ten thousand only) with two sureties for the II|ke Sum each tO the SatiSfaCtI-On Of the learned XIll Additional District and sessions Judge, Visakhapatnam dI-Strict at Gajuwaka,I (ii) On release, the petl-tI'Oner Shall appear before the Station House Officer concerned once in a week i.e. on every sunday between 10.00 a.m. and o5.00 p.m., tI-ll filing of charge sheet. 8.
