BEFORE HONOURABLE MR. JUSTICE SANJAY KUMAR MEDHI ORDER 30.07.2025 Heard Shri HR Ahmed, learned counsel for the petitioner. Also heard Shri SS Roy, learned State Counsel and Ms. G. Hazarika, learned Standing Counsel, Revenue Department. 2. Considering the subject matter involved and the written instructions placed on record by the learned State Counsel, this writ petition is taken up for disposal at the motion stage. Suffice it to mention that this Court had passed an order dated 18.11.2024 directing learned State Counsel to obtain instructions, pursuant to which such instructions have been obtained. 3. The grievance of the petitioner in this petition instituted under Article 226 of the Constitution of India is related to a claim for compensation. The said claim is on account of a fire incident wherein it has been alleged that two dwelling houses, kitchen and other household properties were damaged. The petitioner had accordingly applied for compensation and a report was also prepared on 17.03.2021 followed by a communication dated 11.08.2021 by the Circle Officer, Bagribari Revenue Circle in the district of Kokrajhar. However, no ex-gratia was paid to the petitioner which led him to approach this Court. 4. On a specific query, Shri Roy, learned State Counsel has submitted that such compensation is payable under the Scheme of SDRF/NDRF. He has informed that during the pendency of this case, as per the SDRF Norms, an amount of Rs.95,100/-, have been sanctioned vide order dated 29.11.2024. Page No.# 3/3 Copy of the said sanction order has also been placed before this Court. 5.
This Court is of the opinion that since the substantive steps towards sanctioning of the ex-gratia has already been taken, there would be no requirement to keep this writ petition pending any longer. 6. The writ petition is disposed of by directing for release of the sanctioned amount to the petitioner expeditiously and preferably within an outer limit of 90 days from today. 7. The written instructions along with the copy of the sanction order dated 29.11.2024 are made part of the records. JUDGE Comparing Assistant
