These bail applications have been filed on behalf of the accused-petitioners under Section 483 of B.N.S.S. in connection with FIR No. 290/2025 registered at Nagar, District Deeg for offences under Sections 319(2), 318(4), 338, 336(3), 340(2), 317(2), 317(4), 317(5), 303(2), 313, 61(2)(a) of BNS and Section 66-D of the IT Act. (2 of 3) [CRLMB-16043/2025] 2. Learned counsel for the petitioners submit that the petitioners, who are young and innocent boys, have been falsely implicated in this case and they have nothing to do with the alleged offences. Learned counsel further submit that there is no criminal antecedent against the petitioners, however, two complaints have been found to be registered against one of the petitioners namely, Javed on the National Cyber Crime Reporting Portal (N.C.C.R.P.), involving an amount of Rs. 21500/-. Learned counsel also submit that the petitioners are in custody since long; no recovery is required to be made from them, charge-sheet has already been filed in the matter and the trial of the case will take considerably long time in its conclusion, so no fruitful purpose would be served by keeping them in custody, therefore, pray to enlarge the petitioners on bail. 3. Per contra, learned Public Prosecutor vehemently opposes the submissions made by learned counsel for the petitioners hereinabove and submits that the offence involves serious cyber fraud activities. 4. Taking into consideration the overall facts and circumstances of the case; the arguments advanced by learned counsel for the petitioners and the facts that charge-sheet has already been filed in the matter and trial of the case will take considerably long time in its conclusion, thus, without commenting anything on merits / demerits of the case, this Court deems it just and proper to enlarge the petitioners on bail. 5. Therefore, both the bail applications under Section 483 B.N.S.S. are allowed and the accused-petitioners, namely Adil (3 of 3) [CRLMB-16043/2025] S/o Yaqub and Javed S/o Gafur, are ordered to be released on bail, provided each of them furnishes a personal bond in the sum of Rs. 50,000/- with two sureties of Rs. 25,000/- each to the satisfaction of the trial Court, with the stipulation that they shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 6. It is made clear that the accused-petitioners shall not indulge in any other offence(s) during currency of the bail. 7. The accused-petitioners are directed to mark their presence before the concerned Police Station on the 25th day of every month till conclusion of trial and the SHO of the concerned Police Station shall forward petitioners’ attendance report to the trial Court on the same day of each month. 8. In case of breach of any of the aforesaid conditions, the learned Public Prosecutor shall be at liberty to move an application against the petitioners for cancellation of bail before the concerned Court. 9.
