Learned counsel for respondent No.1 submits that the challenge in this writ petition is to a recommendation dated 30.03.2013 passed by the Departmental 2 Promotion Committee (for short ‘D.P.C.’) by making a recommendation of promotion of Respondent No.2 (who was working on the post of AG II) form the post of Assistant Grade II to Assistant Grade I w.e.f. 01.10.2013. He further submits that the promotion to respondent No.2 could not be made because of the extension of the age of superannuation from 60 years to 62 years of the employee who was to retire after attaining the age of superannuation and he could not be retired form the said post. Therefore, no promotion order of Respondent No.2 was issued on the strength of recommendation dated 30.03.2012 (Annexure P/5) made by the D.P.C.. Therefore, in sum and substance this petition has become infructuous. 2. As no representation is made by counsel for the appellant, this Court left with no other option except to dismiss the petition for want of prosecution. CC as per rules.
