THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE E.S.INDIRESH ORAL ORDER 1. In this writ petition, petitioner is seeking writ of mandamus against the respondent to cancel the result of mid- term examination and to conduct fresh mid-term examination for the petitioner, inter alia sought for a specific direction to the respondent to putforth the criteria for awarding gold medal in M.Tech in Robotics and Autonomous Systems, Robert Bosch Centre for Cyber-Physical Systems. 2. Having heard the learned counsel appearing for the petitioner and respondent herein, the petitioner has sought for - 3 - HC-KAR NC: 2025:KHC:20882 WP No. 9306 of 2024 a direction to the respondent to cancel the result of the mid- term examination said to have been conducted on 21.01.2023. It is not in dispute that result of the mid-term examination was announced immediately thereafter. It is also to be noted that the final exam was conducted on 24.06.2023 and the marks awarded to the candidates was announced immediately after the conclusion of the final exam on 24.06.2023 and therefore, the prayer made in the writ petition does not survive for consideration. 3. In that view of the matter, since the Writ Petition is filed on 18.03.2024, seeking writ of mandamus to the respondent - authorities to cancel the result of mid-term examination and to conduct fresh mid-term examination, the said prayer does not survive at this stage on the ground that respondent - Institution has already concluded the final examination on 24.06.2023 after evaluating the marks obtained by such candidates who had appeared for the M.Tech. examination. It is also to be noted that, the petitioner has not stated any violation of rule or regulation by the respondent - Institution. Following the declaration of law made by the Hon'ble Supreme - 4 - HC-KAR NC: 2025:KHC:20882 WP No. 9306 of 2024 Court in the case of MEDICAL COUNCIL OF INDIA Vs. SARANG AND OTHERS, reported in (2001) 8 SCC 427, I am of the view that, this Court cannot interfere with the academic matters of the respondent - Institution. It is also to be noted that, as per the declaration of law made by the Hon'ble Supreme Court in PRAMOD KUMAR SRIVASTAVA Vs. CHAIRMAN, BIHAR PUBLIC SERVICE COMMISSION, PATNA AND OTHERS, reported in (2004) 6 SCC 714, wherein it is held that, in the absence of any provision for re-evaluation in the relevant Rules with regard to academic examination, no candidate in an examination has got any right whatsoever to claim or ask for re-evaluation or to seek relief of re-conducting examination. In that view of the matter, I am of the view that, no interference is called for in this writ petition and accordingly, the writ petition is liable to be dismissed. 5. It is also to be noted that the petitioner has participated in the final examination held on 24.06.2023 and therefore, cannot seek for re-conducting mid-term examination which was already concluded on 21.01.2023 and therefore, I find force in the submission made by learned counsel for the respondent - - 5 - HC-KAR NC: 2025:KHC:20882 WP No. 9306 of 2024 Institution. It is also to be noted that the delay in filing the writ petition also accounts for negating the relief claimed by the petitioner in this writ petition. 6.
