THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MS JUSTICE J.M.KHAZI ORAL ORDER This petition filed under Section 482 of the Code of Criminal Procedure is by accused Nos.2 to 4, wherein they are seeking discharge for the offences punishable under Sections 498A r/w 34 IPC and Sections 3 and 4 of Dowry Prohibition Act, 1961 (for short 'DP Act'). 2. Respondent No.2/complainant is the wife of accused No.1. Accused Nos.2 to 4 are the brother and parents of accused No.1. Alleging dowry harassment complainant filed the instant complaint. As there was stay so far as accused Nos.2 to 4 are concerned, charge sheet came to be filed against accused No.1. The documents produced by the learned counsel for petitioners indicate that after trial, he is acquitted. It is submitted by the learned counsel for petitioners that accused No.1 and respondent No.2 have taken decree of divorce in MC.No.413/2025 by mutual consent. The order sheet, memorandum of settlement are produced to evidence the said fact. In the memorandum of settlement, the respondent No.2/complainant has undertaken to co- operate to get the pending criminal case quashed. In the light of the above facts and circumstances, the petitioners/accused Nos.2 to 4 are entitled for quashing of the criminal proceedings pending the present petition and accordingly, the following: - 4 - HC-KAR NC: 2025:KHC:20482 CRL.P No. 3505 of 2022 ORDER (i) Petition filed by the accused Nos.2 to 4 under Section 482 Cr.P.C is hereby allowed. (ii) The criminal proceedings against accused Nos.2 to 4 in Cr.No.83/2022, on the file of 24th ACMM, Bengaluru for the offences punishable under Sections 498-A r/w Section 34 of IPC and Sections 3 and 4 of DP Act, is hereby quashed.
