The Trial Court Records placed by the office of the Registrar (Judicial Service) portrayed that the respondents/Insurance Company did not deposit the compensation awarded to the extent of Rs.6,99,000/- before the office of the Learned Tribunal. Accordingly, the paragraph 9 of the judgment dated 7.5.2025 is modified to the extent that the appellants/claimants are entitled to a sum of Rs.8,15,250/-. The chart under which the compensation was granted in Paragraph 8 bear the column “Award received” to the tune of Rs.6,99,000/- and the same should be deleted. The last column should mention Rs.8,15,250/-.
The paragraph 10 of the aforesaid judgment is modified to the extent that the learned Advocate representing the respondent no.1/Insurance Company is to deposit a sum of Rs.8,15,250/- along with interest at the rate of 6% p.a. from the date of filing of the
2 application under Section 166 of the MV Act till the date of its realization at the office of the learned Registrar General, High Court at Calcutta within 10 weeks from the date of passing of this order. The remaining portion of the judgment remains unaltered.
