SREENIVASA REDDY criminal petition No.5976 off 2025 Order: The Criminal Petition, under Sections 480 & 483 of B.N.S.S., has been filed by the petitioner/A-8, seeking regular bail, in crime No.117 of 2023 of Cheedikada Police Station, Anakapalli District. 2. A case has been registered against the petitioner and others for the offences punishable under Sections 20(b)(ii)(C), 25 r/w 8(c)` of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3. Case of the prosecution,tin brief, is that, on 28.O8.2023 at about 18.OO hours, on credible information about illegal transportation of ganja, SI of Police, Cheedikada Police Station, along with his staff and mediators, proceeded to G. Kothapalli Road, cheedikada Mandal, and found Al and A2 in possession of 80 Kgs of ganja worth of Rs.2,40,000/-. The contraband, along with other material, was seized under the cover of mediators report and accused persons were arrested and remanded to judicial custody. 4. Learned counsel for the petitioner submits that the petitioner was shown as Accused No.8 basing on the confessional Statement of co-accused.,. and- I:hat he has been languishing in jail since 13-05.2O25. EEEEEEl e 5. Leamed Assistant Public Prosecutor submits that major portion of the investigation 'has been completed. 6. Heard. Perused the record. 7. Basing on the confessional statemen-I of Al and A2, a case has been registered against the petitioner herein and the petitioner herein was not apprehended at the scene of offence. The petitioner was arrested and sent to judic|la] remand on I_3.05.2025 and since then he is in jail. Considering the facts and circumstances of the case, this Court is inclined to release the pe-titioner on bail. 8. Accordingly, the Criminal Petition is allowed. The pet'ltioner/ Accused No.8 shall be released on bail on executing a personal bond for Rs.10,000,J-(Rupees Ten Th'ousand only) wit:h two sureties for the like sum to the satisfaction of -the learned I Additional District & Sessions Judge-Gum-Special Judge for trial of Offences under the NDPS Act, Visakhapatnam.
