JUSTICE ROBIN PHUKAN ORDER Date : 20.03.2025 Heard Mr. H. Baruah, learned counsel for the applicants also heard Mr. R. C. Paul, learned counsel for the respondent Nos. 1,2 & 3. 2. This interlocutory application under Order XXII Rule 4 of Code of Civil Procedure is preferred by the applicant for substitution of the legal heirs of respondent No.4 in CRP No. 360/2015 who, suffered demised on 27.05.2007. Page No.# 4/4 3. Mr. Baruah, learned counsel for the applicants submits that the respondent No.4 suffered demised on 27.05.2007, and as such, there is a requirement of impleadment of legal heirs of the said respondent No.4, and therefore, Mr. Baruah, has contended to allow this petition by impleading the legal heirs, namely, Smt. Anita Boro, Smt. Susmita Boro, Smt. Amarandra Boro and Sri Chandan Boro of the respondent No.4. 4. Mr. Paul, learned counsel for the respondent Nos. 1,2 & 3 submits that he has no objection in the event of impleadment of the legal heirs of the respondent No.4. 5. Taking note of the submission of learned advocates of both the parties and also considering the facts and circumstances on the record, this Court is inclined to allow this application. 6. The legal heirs of the respondent No.4, be impleaded in the CRP No. 360/2018 as 4(a), 4(b), 4(c) and 4 (d). 7. In view of the order passed in I.A. the learned counsel for the petitioner in CRP No. 360/2015 shall file amended cause-title within a period of three working days from today and Registry shall list this CRP NO. 360/2015, for final disposal on 03.04.2025, as the top of the list. 8.
