Order : The Criminal Petition, under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A-3, seeking regular bail, in Crime No.61 tof 2023 of Ravikamatham Police Station, Anakapalli District. 2. A case has been registered against the petitioner and others for the offence punishable under Section 20(b)(ii)(C) r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3. Case of the prosecution, in brief, is that on 12.07.2023 at 10.00 hours, Sub-Inspector 'of Police, Ravikamatham PS, at Ravikamatham Junction, Ravikamatham Village and Mandal, found Al and A2 in possession of 21 Kgs of ganja worth of Rs.1,O5,000/-in a gunny bag. On interrogation, they stated that they purchased the said ganja from petitioner/A3. Al and A2 were arrested and remanded to judia'al custody. A3 was apprehended on 26.04.2025 and since then, he is in judicial custody. 4. Learned counsel for the,petitioner submits that the petitioner was shown as Accused No.3 basing on the confessional statement of co-accused, and he has been languishing in jail since 26.04.2025. i'\ 'i i --.g
5. Learned Assistant Public Prosecutor Submits that major POrtiOn of the invest|lgation has been completed. 6. Heard. Perused the record. 7. Basing on the COnfeSSiOnal Statement Of CO-accused, a Case has been registered against the petitioner here'ln and the petit-IOner herein was not apprehended at the scene of offence. The petitioner was arrested and sent to judicial remand on 26.04.2025 and since then he is in jail. considering the facts and circumstances of the case, this court 'ls inclined to release I-he petitioner on bail. 8. Accordingly, the Criminal Petition iS allowed. The petitioner/ Accused No.3 shall be released on bail on executing a Personal bond for Rs,10,000/-(Rupees Ten Thousand only) With two Sureties for the like sum to the Satisfaction Of the learned I Additional District & sessions Judge-cum-Special Judge for trial Of Offences under the NDPS Act, Visakhapatnam.
