This petition has been filed by the petiitoner seeking to condone the delay of 944 days in filing the appeal. 2.Heard the learned counsel for the petitioner and the learned counsel for the 2nd respondent. 3.The petitioner would aver that due to the untimely demise of petitioner's husband in the accident, she struggled to meet out her family expenses and also litigation expenses and in the course of which, there occurred a delay of 944 days in filing the above CMA. Therefore the delay is neither wilful nor wanton, but due to the above said reason. Hence, he prayed for condoning the delay of 944 days in filing the appeal. 4.Being satisfied with the reasons stated in the affidavit filed in support of this petition, this Civil Miscellaneous Petition is ordered and the delay of 944 days in filing the above appeal is hereby condoned. 24.10.2025 msr Note: Registry is directed to number the appeal, if it is, otherwise in order.
