Mr. Santanu Chatterjee appearing for the petitioner in his usual fairness submits that the bank had not been made a party in the writ petition and hence, the question of maintaining status quo in so far as the usufructs of the bank account was concerned were not binding on the bank. In fact, as Mr. Smarajit Roy Chowdhury appearing for the alleged contemnor submits that the alleged transaction debiting the account occurred on February 11, 2013, which was in the system of auto debit, the same could not be stopped without adequate notice and or knowledge of such order being conveyed and communicated to the bank. In view of the aforestated, the comtempt petition fails and is hereby dismissed. There will be no order as to costs.
