Mr. Shyam Babu Vaish, Advocate has filed his vakalatnama on behalf of respondent no. 4, which is taken on record. 2. Report/instruction dated 17.3.2025 sent by the Consolidation Officer, Sadar, District : Bulandshahr is also taken on record. 3. The instant petition has been filed for the following relief:- "Issue a writ, order or direction in the nature of mandamus to direct the respondent no. 3, Consolidation Officer, Shkarpur-I, Bulandsshahr to expedite the hearing / disposal of Case NO. 148 under Section 9(A) 2 of UPCH Act pending sine the date of remand order dated 12.4.2023 passed by the Settlement Officer, Bulandshahrf in Appeal No. 176 under Section 11(1) of UPCH Act within reasonable time period as may be fixed by this Hon'ble Court. (ii) Issue a writ, order or direction in the nature of mandamus restraining the respondents not to create any hindrance in peaceful possession of petitioner over the land measuring 0.126 hectare in Khata No. 776 situated in village Kasumi (Pahasu) Tehsil Shikarpur, District - Bulandshahr till the disposal of the case no. 148 under Section 9(A) 2 of UPCH Actd pending before the Consolidation Officer, Shikarpur-I, Bulandshahr." 4. Mr. Hari Mohan Srivastava, learned Additional Chief Standing Counsel for the State, on the basis of report/instruction submitted that the next date fixed in the aforesaid proceeding under Section 9(A) 2 of the UPCH Act is 25.7.2025 and the matter shall be decided expeditiously by the court concerned,. He further submitted that respondent no. 4 has applied for transfer of the proceeding under Section 9(A) 2 of the UPCH Act before the Settlement Officer of Consolidation, Bulandshahr which is pending for disposal. 5. Considering the entire facts and circumstances of the case, the instant petition is finally disposed of directing respondent no. 3 / Consolidation Officer, Shikarpur-I,. Bulandshahr to decide the aforementioned proceeding under Section 9(A) 2 of the UPCH Act expeditiously, preferably, within within a period of three months from the date of production of certified copy of this order after affording proper opportunity of hearing to both the parties.
