Heard learned counsels for the parties. 2. The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Sections 17(c), 18(c), 22(c) and 29 of the N.D.P.S. Act in connection with Katkamsandi P.S. Case No.399 of 2023. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case only on the basis of confessional statement of the co-accused persons and he has not committed any offence as alleged in the F.I.R. He further submits that no narcotic substance has been recovered from the conscious possession of the petitioner nor the petitioner has been arrested from the place of occurrence. He further submits that the co-accused persons namely Tanjil Alam and Maksud Khan who have confessed the name of the petitioner have already been granted bail by this court in B.A. No.2081 of 2024 and B.A. No.1872 of 2024 respectively and petitioner for no offence has been languishing in custody since 23.05.2025; as such, the petitioner may be enlarged on bail. He submits that the petitioner is ready to abide by every condition as imposed by this court. 4. Learned A.P.P. opposes the prayer for bail of the petitioner. 5. Having regard to the facts of the case and looking to the allegation made against this petitioner coupled with the fact that the co- 2025:JHHC:23034 2 accused persons have already been granted bail; therefore, I am inclined to enlarge this petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-cum-Special Judge, NDPS, Hazaribag in connection with Katkamsandi P.S. Case No.399 of 2023. 6. It is made clear that the petitioner shall appear on each and every date before the learned trial court and he shall not threaten any witnesses and shall co-operate in trial and if any adverse report will come against this petitioner, learned trial court shall be at liberty to cancel the bail of this petitioner.
