He further submits that the evidence of the plaintiff has been closed and by order dated 02.05.2018 and --2-- C.M.P. No. 782 of 2023 24.07.2018 the petitioner’s evidence has been closed and the matter is posted for hearing. He submits that the petitioner has not been able to appear before the learned Court due to prolong illness of his wife and during the pendency of the civil suit she left for her heavenly abode and in light of that this petition has been filed to recall and allow the petitioner to lead evidence on behalf of the defendant, however, the said has been rejected on the ground that the defence of defendant has already closed.
