Neutral Citation No. - 2025:AHC:128382 Court No. - 79 Case :- APPLICATION U/S 528 BNSS No. - 5925 of 2025 Applicant :- Harish Chandra @ Hari Chand Opposite Party :- State of U.P. and Another Counsel for Applicant :- Rubi Singh,Vijay Tripathi Counsel for Opposite Party :- G.A.,Girish Kumar,Rajeev Kumar Hon'ble Sandeep Jain,J. On 20.05.2025, it was directed by this Court that Station House Officer, Police Station Nibohara, District Agra to verify the veracity of the compromise by recording the statement of the victim/ complainant and submit its detailed report through Superintendent of Police, Agra. In compliance of the order dated 20.05.2025, an affidavit has been filed by learned AGA which has already been on record. On perusal of the said affidavit, it is evident that there was a matrimonial dispute between the parties due to which the victim has lodged Case Crime No. 30 of 2021, under Sections 498A, 323, 504 I.P.C. and 3/4 Dowry Prohibition Act, Police Station Nagla Singhi, District Firozabad as well as Case Crime No.74 of 2021, under Sections 376, 511, 452, 506 I.P.C. (State Vs. Harishchandra @ Harichandra) against her father-in-law. It was alleged that in Case Crime No. 74 of 2021, the victim was raped by her father-in-law. It is also apparent that due to matrimonial dispute these cases were got registered in which a compromise has been reached between the parties and as such the parties have amicably settled their dispute. In this case the applicant is the father-in-law of the victim.
In view of the facts and circumstances of the case since a compromise has been reached between the parties and all the pending cases between them have been amicably resolved, no useful purpose would be served in continuing the proceedings of the instant criminal case as the parties have amicably settled their dispute. Accordingly, the proceedings of Session Trial No. 2618 of 2023 (State Vs. Harish Chandra @ Hari Chandra), arising out of Case Crime no.74 of 2021, under Sections 376, 452, 506, 511 I.P.C., Police Station Nobohara, District Agra, pending in the court of Additional Sessions Judge, Court No.23, Agra, on the basis of compromise are hereby quashed.
