Respondent(s) 2 For Petitioners : Mr. Shobhit Koshta, Advocate Hon’ble Shri Justice Rakesh Mohan Pandey Judgment On Board 02 /05/2025 1) By way of this petition, the petitioner has sought the following relief(s):- 10.1) This Hon'ble Court may also be further pleased to issue direction to the learned court to expeditiously conclude the matter within such outer limit as the court may deem fit in the facts and circumstances of the case. 10.2) This Hon'ble Court may kindly be pleased to call for the entire records of the court below, for kind perusal of this Hon'ble Court. 10.3) This Hon'ble Court may also be pleased to grant the cost of the petition to the petitioners. 2) Learned counsel for the petitioners/decree holders submits that petitioners filed a suit for eviction against the respondents which was initially dismissed by the trial Court but the same was allowed by this Court vide judgment and decree dated 08.07.2022 passed in FA No. 63/2018. He contends that judgment and decree passed by this Court have been affirmed by the Hon’ble Supreme Court in SLP(Civil) Diary No. 37446/2022 dated 17.03.2023. He argues that thereafter, application for execution was moved before the learned Executing Court on 28.03.2023, but there is no substantial progress. He prays that a direction may be issued to the learned Executing Court to conclude the proceedings at the earliest in light of the judgment passed by the Hon’ble Supreme Court in the matter of Rahul S. Shah vs. Jitendra Kumar Gandhi, 2021 (6) SCC 418. 3) Heard. 3 4) Having considered the limited prayer made by Mr. Koshta, the instant petition is disposed of with a direction to the learned Executing Court to make all endeavors to conclude the execution proceedings keeping in mind the judgment passed by the Hon’ble Supreme Court in the matter of Rahul S.
