Hon'ble Vivek Kumar Birla,J. Hon'ble Mohd. Azhar Husain Idrisi,J.
1. Heard Sri Akhileshwar Pratap Singh, learned counsel for the petitioner and Sri Om Prakash Dwivedi, learned A.G.A. for the State. 2. The relief sought in this petition is for quashing of the F.I.R. dated 22.06.2024, registered as Case Crime No. 295 of 2024, under Sections 420, 406, 467, 468, 471, 506 I.P.C., Police Station Bithari, District Chainpur. Further prayer has been made not to arrest the petitioner in the aforesaid case. 3. Submissions of learned counsel for the petitioner is that the petitioner has not committed any offence and he has no role to play in the present case. He was only instrumental in creating acquaintance between Ram Babu and Arun Babu the first informant herein. There was no money transaction in favour of the petitioner and he has not at all instrumental in executing any document and therefore, none of the offence as alleged is made out against the petitioner prior to lodging of the FIR the actual owner has lodged one FIR wherein the petitioner was not named and there was no allegations against the petitioner therein. 4. Per contra, learned A.G.A. pointed out that out of seven accused persons charge sheet no. 40 of 2025 dated 12.11.2024 has been forwarded against Ram Babu, however, all other six co-accused persons including the petitioner herein are absconding and are not cooperating in the investigation and submits that on a bare glance a cognizable offence is made out. In this background, we find no good ground to interfere in the instant case and there can be no part of quashing. 5. Therefore, in view of the law laid down by Hon'ble Supreme Court in the case of State of Haryana and others vs. Bhajan Lal
and others, 1992 Supp. (1) SCC 335 and M/s Neeharika Infrastructure Pvt. Ltd. vs. State of Maharashtra, AIR 2021 SC 1918 and in Special Leave to Appeal (Crl.) No.3262/2021 (Leelavati Devi @ Leelawati & another vs. the State of Uttar Pradesh) decided on 07.10.2021, no case has been made out for interference with the impugned first information report. 6.
