Heard Mr. U.U. Khan, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State.
2. This application filed under section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, the accused petitioner namely, Brijlal Yadav @ Brijraj, has prayed for bail in connection with CID P.S. case No. 18/2015, who was arrested on 21.08.2025 under Section 120B/387/420 IPC R/W Section
Page No.# 2/2 66D/67D of I.T. Act.
3. The case diary is available but learned additional P.P. took further instructions and submits that investigation is not yet completed. The applicable statutory period is stated to be 60 days and in this context the learned counsel for the petitioner submits that the accused has completed 63 days in detention and thereby become to entitled to default bail
4. Accordingly, the accused-petitioner, named above, shall be released on bail in connection with CID P.S. case No. 18/2015 under Section 120B/387/420 IPC R/W Section 66D/67D of I.T. Act on furnishing bail bond of Rs.35,000/- with one suitable surety of the like amount to the satisfaction of learned concerned Court CJM, Kamurp (M).
5. The direction for bail is further subject to the conditions: (a) That the accused person shall co-operate with the remaining investigation; (b) That the accused persons shall not hamper or tamper with evidence; and (c) That the petitioner shall not misuse his liberty to commit any illegal activities.
6. Violation or breach of any condition(s) shall entail cancellation of bail.
7. With the above observations, this bail petition stands allowed and
disposed of accordingly.
