This is an application for setting aside abatement and granting the permission to substitute the legal heirs and representatives of the deceased respondent no. 2, namely late Deokon Dutta under Order 22 Rule 4 read with Section 151 of the Code of Civil Procedure. It is submitted that during the pendency of the connected appeal, the respondent no. 2, namely late Deokon Dutta expired and the applicant had no knowledge of it, however, they came to know about the death of the respondent Page No.# 3/3 no. 2 from the service report dated 23.02.2024. Thereafter, the applicant tried to collect the information, but inadvertently some delay has been caused while collecting the information and drafting the Miscellaneous application, and, hence, prays for setting aside the abatement. Mr. A. R. Shome, learned counsel for the respondent is also present and he has submitted that the respondent would have no objection. In view of the above, prayer is allowed and the abatement that occurred due to the death of the respondent no. 2 is hereby set aside. With the above, this IA stands disposed of.
