Accused No.1 in Cr.No.465/2024 registered by Electronic City Police Station, Bengaluru for the offences punishable under Section 103 read with 3(5) of Bharatiya Nyaya Sanhita, 2023 is before this Court under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Cr.No.465/2024 was registered by the Electronic City Police Station, Bengaluru, initially for the offence punishable under Section 103 of BNS, 2023 against unknown person based on the First Information dated 21.10.2024 received from Deepika Singh W/o deceased Sarvesh Singh. During the course of investigation of the case, petitioner herein was arrested on 21.10.2024. After completion of investigation, charge sheet has been filed against the accused persons, wherein the petitioner has been arrayed as accused No.1 in the charge sheet. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.230/2025 was - 3 - NC: 2025:KHC:15469 CRL.P No. 3849 of 2025 rejected on 01.03.2025. Therefore, petitioner is before this Court. 4. A perusal of the material on record would go to show that FIR was registered against unknown persons after the dead body of the deceased was found by his wife Deepika Singh. During the course of investigation, accused Nos.1 and 2 were arrested. After the investigation was completed, charge sheet has been filed against them for the aforesaid offence. In the said charge sheet it is alleged that on the night of 20.10.2024 at about 10.00 pm, the deceased Sarvesh had purchased alcohol from the shop of CWs.17 and 18 and accused Nos.1 and 2 also had purchased liquor from the very same shop. While purchasing the alcohol, accused No.1 allegedly had touched the deceased and therefore, the accused and the deceased had fought against each other. In the charge sheet it is alleged that thereafter at about 10.30 pm, the accused had followed deceased Sarvesh Singh and within the jurisdiction Electronic City Police Station, they had caught hold of deceased and accused No.1 allegedly - 4 - NC: 2025:KHC:15469 CRL.P No. 3849 of 2025 pushed deceased to the ground and had pressed his neck to the ground and accused No.2 allegedly picked up a tile which was lying nearby and assaulted deceased with same on his face and head and caused his murder. Undisputedly, the entire case of the prosecution is based on circumstantial evidence. Accused No.2 who is arrested in the present case is in judicial custody. The petitioner has no other criminal antecedents and is said to be a married person having a family. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following:- ORDER The petition is allowed. The petitioner is directed to be enlarged on bail in Cr.No.465/2024 of Electronic City Police Station, Bengaluru registered for the offences punishable under Section 103 read with 3(5) of Bharatiya Nyaya Sanhita, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties, out - 5 - NC: 2025:KHC:15469 CRL.P No. 3849 of 2025 of which, one should be local surety for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
