A case has been registered against the petitioner for the offence punishable u/Sec.109(1) of the B.N.S. Case of the prosecution in brief, is that, on 23.3.2025 at about 6.30pm, the complainant made a complaint stating that his son was having extra , martial relationship with the wife of the accused. Later, the wife of the accused went to her parents’ house. Since then the accused bore grudge against his son and on 23.3.2025 at about 6.30pm, the accused was alleged to have made an attempt to commit murder of complainant’s son. However, he was rescued and shifted to the hospital for treatment. The case has been reported 2. 3. and it was registered as an F.I.R. Heard learned counsel for the petitioner and learned Assistant Public 4. Prosecutor for respondent-State. Perused the record. Learned Assistant Public Prosecutor submits that investigation is going 5. on and some more witnesses are to be examined. 6. A perusal of the material available on record goes to show that the petitioner is alleged to have attacked the de facto complainant on the ground that he has illegal relationship with his wife. Specific act has been against the petitioner. Hence, this Court is not inclined to consider the of the petitioner for grant of anticipatory bail. However, the petitioner shall surrender and make attributed as prayer 7. an application for bail. and on making such application before the Jurisdiction Court for the learned Judge is directed to dispose of the same grant of bail. on the same day, on accused and the de facto merits, keeping in view of the fact that, the complainant are related to each other.
