[2025:RJ-JP:28487] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 7053/2025 Mahesh @ Nakad S/o Chingaram, Aged About 42 Years, R/o Keshavpura Hindaun City, P.S. Hindaun City District Karauli (Raj.) (Confined At Sub Jail Hindaun City). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Anil Kumar Shukla For Respondent(s) : Mr. Naresh Kumar Gupta, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 29/07/2025 1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.0194/2024 registered at Police Station-Hindaun, District-Karauli for offences under Sections 8/21, 8/25 and 8/29 of the NDPS Act. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. No recovery has been affected from the conscious possession of the petitioner. It is submitted that the recovered quantity of smack is 14.93 grams, which is below the commercial quantity. The petitioner is behind the bars since 09.08.2024 and charge-sheet has been filed. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further [2025:RJ-JP:28487] (2 of 2) [CRLMB-7053/2025] custody, hence the bail application of the petitioner may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application and stated that the petitioner has the history of nine criminal cases out of which eight cases are of similar nature registered under NDPS Act, which shows criminal intent of the petitioner and granting bail to such an individual would have an adverse impact on society, hence his bail may be rejected. 5. On consideration of the rival submissions and material available on record and deliberating all the facts and circumstances of the case, especially in backdrop of gravity of offence as well as criminal antecedents of like nature but without expressing any opinion on the merits/demerits of the case, I am not inclined to grant benefit of bail to the petitioner. 6. Accordingly, the bail application under Section 483 B.N.S.S. is dismissed. (PRAMIL KUMAR MATHUR),J Sunita/165
