JUSTICE PRANJAL DAS ORDER 23.10.2025 1. Heard Mr. F. Haque, learned counsel for the petitioner. Also heard Page No.# 2/3 Ms. S. H. Bora, learned Additional Public Prosecutor for the State. 2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioner, namely, 1. Abdul Kayum, praying for grant of bail in connection with Barama P.S. Case No.61/2025 under Section 310(2), added Sections 61(2)/140(2)/317(3)/310(5)/ 310(6)/111(2)(b)/ 111(3)/ 111(4) of BNS, 2023. 3. The allegation in the FIR dated 16.07.2025 is dacoity of a truck bearing registration No. RJ09QE6232 carrying pan masala of Rs.80 lakhs. 4. It is submitted by the learned Additional Public Prosecutor that in the meantime upon completion of investigation charge-sheet has been submitted in the case. In this context, learned counsel for the petitioner submits that some co-accused have already been granted bail by this Court yesterday on the said ground of completion of investigation. 5. In the aforesaid facts and circumstances, this bail petition is allowed. The accused petitioner, named above, shall be released on bail of Rs.30,000/- with one suitable surety of like amount to the satisfaction of learned concerned court subject to the following conditions that the accused: (a) shall not abscond. (b) shall be available for trial. (c) shall not hamper or tamper with the evidence. (d) shall not misuse his liberty to commit any illegal act or offences. Page No.# 3/3 6.
