Parashar, learned Addl. Public Prosecutor appearing for the State. By this application, the petitioner has prayed for bail in connection with Paltan Bazar P.S Case No. 281/2025 registered under Section 143(3)/144(2) of Page No.# 2/3 BNS read with Section 3(2)()b/4/5(1)(d)/6(1)()b of Immoral Traffic (Prevention) Act, 1956. The FIR dated 14.09.2025 reveals that the petitioner is alleged to have trapped the victim for keeping her in her house as a housekeeper and that when the victim reached Guwahati, the petitioner attempted to get her involved in prostitution and that she was assaulted too. Mr. A. Ahmed, learned counsel appearing for the petitioner submits that the victim is above 18 years of age and that she has given her statement under Section 183 of BNSS and the police on completion of the investigation has submitted charge sheet against the petitioner. He further submits that the story narrated in the FIR was a concocted one and that the victim worked in the house of the petitioner and due to some salary issues, the victim had alleged the said facts in the FIR. Mr. K.K. Parashar, learned Addl. Public Prosecutor however, submits that it is not clear as to whether the victim was minor or above 18 years and that he has prayed for calling of the records for the same. On consideration of the submissions made at the bar and on perusal of the documents more so due to the fact that the victim was major on a prima facie basis and that she had given her statement and the investigation was also over, this Court deems it fit to release the petitioner on bail on furnishing of a Page No.# 3/3 bail bond of Rs. 20,000/-(Rupees twenty thousand) with one (1) local surety of the like amount to the satisfaction of the CJM, Kamrup(M), Guwahati under the following conditions:- 1) The petitioner shall cooperate with the investigation and shall appear before the CJM, Kamrup(M), Guwahati as and when called for. 2) The petitioner shall not tamper with the evidence or influence any of the witnesses. 3) The petitioner shall not leave the jurisdiction of the CJM, Kamrup(M), Guwahati without prior permission of the concerned Court.
