As per order dated 01.10.2024 passed by respondent-Nigam, it is explicit that on account of earning as many as eight times penalties, benefit of grant of third selection scale to petitioner w.e.f. 23.12.2004 was deferred for a period of ten years w.e.f. 23.12.2014, however, on that date, petitioner was under suspension and during suspension he retired, hence, petitioner was not found eligible to get benefit of the third selection scale. 3. Counsel for petitioner, in his arguments, relied upon the Circular dated 05.06.2012, however, that Circular does not [2025:RJ-JP:25433] (2 of 2) [CW-8488/2025] support the case of petitioner and no case is make out in favour of petitioner that call for any interference in the order impugned dated 01.10.2024. 4. Counsel for petitioner, having instructions of petitioner, seeks permission to withdraw this writ petition. 5. Permission is granted. 6.
