(1) Heard learned counsel for petitioner and learned State Counsel for opposite parties. (2) Petition has been filed seeking a direction to authority concerned for payment of arrears of salary and pension including Family Pension and other retiral benefits of the husband of petitioner. (3) Learned State Counsel submits that earlier husband of petitioner filed Writ-A No. 6621 of 2013, Kashi Ram v. State of U.P. and others, challenging order of removal on the ground of conviction in a criminal case. The said petition was allowed vide judgment and order dated 19.07.2019 granting liberty to opposite parties to pass orders taking into consideration the aspect of conduct of petitioner which led to his conviction. (4) Learned State Counsel has been provided instructions dated 21.10.2025, which are taken on record and as per which, subsequent orders have already been passed on 05.10.2019 again removed petitioner's husband from service but the said order has not been challenged. (5) In view of such an objection being made, learned counsel for petitioner seeks to withdraw the petition with liberty to file a fresh petition to challenge the said order.
