Mr. Vinod Sharma, Advocate, for the applicant/respondent. CMP No. 22723 of 2025 The present application has been filed for discharging the guardian of the applicant in the case at hand. The present applicant had been brought on record as one of the legal representatives of deceased respondent No. 2 (Ghanshyam, S/O late Bir Chand). Since at the time of bringing on record the applicant in the case at hand, the applicant was a minor, her interest was being duly protected by her mother and natural guardian. The present application is duly supported by an affidavit of the applicant. Besides the aforesaid, the matriculation certificate of the applicant also stands appended along with the present application, wherefrom it is evident that the applicant was born on 31.12.2006. Hence on date, she has attained the age of majority. In view of the aforesaid, the application is allowed and the applicant is permitted to pursue the litigation in her own individual capacity. The mother and natural guardian is discharged from acting on behalf of the
present applicant henceforth. Application stands disposed of. CMP No. 22722 of 2025 No reply is intended to be filed on behalf of non- applicant/appellant. The non-applicant/appellant has no objection if in case the present application is allowed and the amount deposited in the Registry of this Court along with interest accrued thereupon is ordered to be released in favour of the present applicant. Learned counsels appearing on behalf of parties submit that the Regular First Appeal in the case at hand was decided on 20.03.2012 and no further proceedings against the said decision are pending before the Hon’ble Apex Court. Hence the judgment so passed on dated 20.03.2012 has attained finality. Other than the aforesaid, for the reasons mentioned in the application, the amount lying deposited in the Registry of this Court is ordered to be released in favour of the applicant in terms of her share, which is mentioned in para No. 7 of the application. The amount be remitted to her bank account details whereof have been given in Paragraph-8 of the application, subject to proper verification. The application stands disposed of.
