At the outset, learned counsel for the appellants submits that this appeal has become infructuous, as after passing the impugned judgment dated 08.03.2022 by the Third Upper District Judge, Balodabazar, District Balodabazar Bhatapara (CG) in Civil Appeal No.53A/2019 whereby the matter has been remitted back to the trial Court, the trial Court has passed the fresh judgment and decree, hence, the appellants do not want to prosecute instant appeal. 3.
