Heard learned counsel for the applicants as well as learned AGA for the State and Shri Prashant Dubey, who has filed vakalatnama on behalf of the complainant which is taken on record. The present application for anticipatory bail has been filed for protection in regard to Case Crime No. 367/2025, U/S- 191(2), 191(3), 333, 109(1), 140(4) Bharitya Nyay Sanhita P.S. Kotwali Nagar, District-Ayodhya. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. It is contended that the complainant has not suffered any grievous or fracture. Relying on the doctor’s statement, learned counsel further submits that no injury has, in fact, been sustained by the complainant. On the other hand, learned A.G.A. and learned counsel for the complainant have opposed the bail application, submitting that the injured sustained nine injuries and the applicant is the sole assailant. He has been clearly identified in the CCTV footage. It is argued that the applicant assaulted the victim inside a room and again after dragging him outside, and the entire incident has been captured on CCTV, from which the applicant’s identity has been established. Thus, it is not a case of false implication. Perused the record, so also the rejection of the order dated 10.9.2025. Home Lko And Another .....Opposite Party(s) operative portion of the order reads as follows: "सुना एवं अिभयोजन प्रपत्रों का अवलोकन िकया। इस प्रकरण में चोटिहल अनुज यादव की इन्जरी िरपोटर् में कु ल 9 चोटें अंिकत हैं िजसमें से दो फटे हुए धाव, एक माथे पर 3X0.5 सेमी तथा एक पैर में 4X1.5 सेमी। एक चोट नाक व कान से ब्लीिडग के रूप में अंिकत है। िजसके कारण िसर का एन.सी.सी.टी कराया गया। इसके अलावा कन्धे पर दो नीलगू िनशान 10X4 तथा 8X4 सेमी के तथा दािहनी जांघ में 16x2 सेमी का नीलगू िनशान और शेष ददर् की िशकायते हैं। िजसमें बाये हाथ की दोनों हिड्डयों के एक्स-रे की सलाह दी गई थी यद्यिप उनमें फै क्चर नहीं पाया गया। अिभयुक्तगण पर आरोप है िक उन्होंने अपने अन्य सािथयों के साथ िदन के समय होम स्टे के अन्दर घुसकर जहां वादी मुकदमा का पुत्र सो रहा था, लाठी डण्डों और लोहे की राड से जान से मारने की िनयत से बुरी तरह मारा पीटा। िजसका वीिडयों सी.सी.टी.वी फु टेज देखकर अिभयुक्तगण की पहचान हुई है। न के वल कमरे में मारा गया है बिल्क बाहर घसीटकर लाकर भी मारा पीटा गया है और िफर होम स्टे से बाहर लाकर स्टेिडयम से पीछे ले जाकर मरा समझ कर फें क कर चले गये हैं। पुिलस आख्या में यह बताया गया है िक अिभयुक्त फरार चल रहे हैं। सह अिभयुक्त राज उफर् गब्बर यादव का जमानत आवेदन पत्र इस न्यायालय द्वारा िदनांक 21.08.2025 को िनरस्त िकया जा चुका है। अंतः प्रकरण के समस्त तथ्यों एवं पिरिस्थितयों को देखते हुए आवेदकगण द्वारा प्रस्तुत अिग्रम जमानत आवेदन पत्र का स्वीकार िकये जाने का आधार पयार्प्त नहीं है। आदेश आवेदकगण / अिभयुक्तगण सोनू साहू उफर् सुनील साहू व अिभ अग्रहिर उफर् अमन अग्रहिर द्वारा मु०अ०सं०-367/2025, धारा- 191(2), 191(3), 333, 109(1), 140 (4) भा०न्याय०सं०, थाना कोतवाली नगर, जनपद-अयोध्या के प्रकरण में प्रस्तुत यह अिग्रम जमानत आवेदन-पत्र िनरस्त िकया जाता है।" Upon perusal of the record and the injury report, it appears that the investigation is in progress and prima facie ample material has been collected showing the complicity of the accused. Hence, it cannot be treated as a case of false implication. Accordingly, considering that anticipatory bail is an exceptional relief, this Court is not inclined to grant the same.
