Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material placed on record. 2. The present 482 Cr.P.C. application has been filed with a prayer to quash the summoning order dated 09.07.2024 and NBW order dated 25.08.2025 passed by Chief Judicial Magistrate, Balrampur as well as the entire proceedings arising out of Complaint Case No.5492 of 2024, under Sections 18(Ga), 27(Kha) (ii) and 18 Ka/28 Drugs and Cosmetics Act, 1940, Police Station Sadulla Nagar, District Balrampur (State vs. Ahmad Raza). 3. At the very outset, counsel for the applicant states that the offence is punishable upto seven years and applicant will surrender before the court below and apply for bail. However, he has submitted that the applicant may be granted the benefit of the case of Satender Kumar Antil Vs. Central Bureau of Investigation and another reported in (AIR 2022 SC 3386). 4. It is therefore, directed that in case the applicant surrenders before the Court below within one week from today and prefers bail application, the court below will decide the said bail application within two weeks thereafter taking into account the law laid down by the Supreme Court in Satender Kumar Antil (supra). 5. For a period of three weeks. no coercive action shall be taken against the applicant in the aforesaid case. 6. The application stands disposed of. 7.
