Heard learned counsel for the applicant and the learned A.G.A. for the State. 2. The present 483 Cr.P.C. application has been filed with a prayer for direction being issued to the Additional Chief Judicial Magistrate, Kunda, Pratapgarh to decide the Case No. 1089 of 2021 (Smt. Rekha vs. Subham Vishwakarma and Others), under Section 12 of the Protection of Women from Domestic Violence Act, 2005 filed on 18.08.2021 expeditiously and in a stipulated time. 3. Submission of the counsel for the applicant is that the aforesaid case is pending since 2021. He submits that there is a provision under Section 12 (5) of The Protection of Women from Domestic Violence Act, 2005 which provides that the Magistrate shall endeavour to dispose of every application made under sub-section (1) within a period of 60 days from the date of its first hearing and almost four years have passed but, no substantial progress has taken place on the said application. 4. In view of the aforesaid fact, I hereby direct the aforesaid concerned Magistrate pending before him to decide the case without granting unnecessary adjournments to either of the parties and also affording opportunity of hearing to all concerned, within a period of four months from the date of production of a certified copy of this Versus Counsel for Applicant(s) : Ankit Tiwari Counsel for Opposite Party(s) : G.A.
