Order 30/07/2025
1. Petition alleges contempt by respondents. According to petitioners, by an order dated 27th July 2023, petitioners were given
[2025:RJ-JP:28922-DB] (2 of 3) [CCP-555/2025] liberty to file a representation before a Public Land Protection Cell (PLPC) for rural areas and respondents were directed to dispose same within a period of five months.
2. Pursuant to said order, petitioners state in contempt petition that they made a representation on 16th August 2023. According to petitioners, they sent a reminder on 15th February 2024 after expiry of five months and another reminder a year later on 7th February
2025. Petitioners state that representation is not yet considered and, therefore, there is willful disobedience of order dated 27th July 2023. What has to be noted is that petitioners have taken their own time to make said reminders. Of course, petitioners were not obliged to send reminders because respondents were expected to comply with order without being reminded to comply with.
3. On 30th June 2025, following order came to be passed:
“Before issuing notice to private respondents, we are inclined to first seek information from District Collector, Alwar as regards compliance of the Court’s
order. Mr. G.S. Gill, learned Additional Advocate General present in the Court may seek instructions and inform the Court accordingly. Two sets of contempt petition be supplied to Mr. G.S. Gill, learned Additional Advocate General within two days. Name of Mr. G.S. Gill, learned Additional Advocate General be shown in the Cause List. List this matter after four weeks.”
4. Mr. G.S. Gill, Additional Advocate General states that despite Court directing petitioners to supply two sets of petition to him within a period of two days, which would not be later than 2nd July 2025, copy of petition has not been served.
5. Mr. James Bedi, counsel states that it has been supplied by his clerk, but he has to verify same. We would expect counsel to be ready with answers when matter is listed.
[2025:RJ-JP:28922-DB] (3 of 3) [CCP-555/2025]
6. Therefore, we are not inclined to entertain this contempt petition. At the same time, we shall direct respondents to take action on representation dated 16th August 2023, Copy whereof has been annexed to this petition. Mr. James Bedi, counsel states that copy of petition shall be handed over in office of Mr. G.S. Gill, Additional Advocate General during course of day and an affidavit of service shall be filed. Respondents shall take action on representation within four weeks from today.
7. Petition disposed.
