SONI SHRIVASTAVA ORAL ORDER 3 17-06-2025 Heard learned counsel for the petitioner and learned APP for the State but despite issuance of notice none has appeared on behalf of opposite party no.2. 2. The petitioner apprehends his arrest for the offences punishable under Sections 323 and 498A/34 of the Indian Penal Code. 3. The prosecution case is based upon the complaint petition in which allegation of demand of dowry and torture has been made. The petitioner is the husband. 4. It is submitted by learned counsel for the petitioner that the allegations made in the complaint are totally false. As a matter of fact, the petitioner is ready to keep the complainant/ Patna High Court CR. MISC. No.11342 of 2025(3) dt.17-06-2025 2/2 opposite party no.2 in his house with full honour and dignity as stated in para-9 of this application. It is further submitted that it would appear from the bail rejection order that it is actually the wife/complainant who has shown her unwillingness to stay with her husband. 5. In such view of the matter, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending/successor Court in connection with Complaint Case No.84 (C) of 2024, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
