ORDER This petition is filed under Article 226 of the Constitution of India for the following relief:-
“…to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in issuing the impugned proceedings vide RC.No.A5/9195/2015, dated 10.12.2015 issued by the 2nd respondent as illegal, null and void and also without jurisdiction and for a consequential order to set aside the same by allowing the petitioners to manage the affairs of the Polisetty Subbarayudu Charities, Chirala Prakasam District be the Founder Family Members and to pass …”. 2
2. This Court on 25.01.2016 while issuing ‘Rule Nisi’ has passed the following interim order:-
“… In view of the same, the impugned proceedings, vide Rc.No.A5/9195/2015, dated 10.12.2015, of respondent No.2, appointing respondent No.4 as the single trustee, ignoring one of the petitioners for appointing as a trustee, cannot be sustained. Hence, the impugned proceedings, vide Rc.No.A5/9195/2012, dated 10.12.2015, of respondent No.2 are suspended pending further orders. Post on 29.02.2016.”

Heard Mr. Maruti Shankar, learned counsel representing on behalf of Mr. Challa Dhanamjaya, learned counsel for the petitioners and the learned Government Pleader for Endowments appearing for the respondents. 5. On hearing, learned counsel for the petitioners submits that while pending the writ petition, petitioners have filed O.A.No.659 of 2014 and the same was allowed in part on 25.07.2023, declaring the petitioner Nos.2 and 3 as members of founder family of Sri Polisetty Subbarayudu Choultry, Kunkalamarru Village, Chirala Mandal of Prakasam District. In view of the same, no cause survives in the present writ petition and it may be closed. 6. Recording the above submissions, the Writ Petition is closed. There shall be no order as to costs. 3
