In this writ petition, petitioner has challenged Notice dated 25.08.2018, issued by District Magistrate, Udham Singh Nagar under Section 3 of U.P. Control of Goondas Act, 1970. 3. Learned State Counsel submits that externment order passed under Section 3(3)(a) of the Act, is valid only for a period of six months. He submits that Writ Petition was filed in 2021 and externment order, if any, passed against petitioner, would have expired long back. 4. This Court finds substance in the said submission. 5. Since there is no interim order passed in the writ petition protecting the petitioner from any action under U.P. Control of Goondas Act, therefore, the externment order passed against petitioner by the Competent Authority must have expired by now. 6. Thus, no useful purpose would be served by keeping this writ petition pending. 7. Accordingly, the Writ Petition is dismissed as infructuous.
