HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 22497 of 2025 Court No. - 44 HON'BLE J.J. MUNIR, J. HON'BLE SANJIV KUMAR, J. In this case, the impugned FIR was lodged against Syed Faisal Rehmani, an insurance agent, who secured business for the ICICI Prudential Life Insurance Company, Aligarh, where many of the beneficiaries were already suffering from deadly diseases like Cancer and some of them were dead by showing them to be alive. It is argued by learned counsel for the petitioner that he is not an agent of the Insurance Company or its Officer. It is further argued by learned Counsel for the petitioner that Syed Faisal Rahmani, who is the main accused, has been granted a stay of arrest till filing of the charge-sheet by a Division Bench of this Court in Criminal Misc. Writ Petition No. 1745 of 2025 vide order dated 31.01.2025. Mr. Shashi Shekhar Tiwari, learned AGA, on the other hand, has placed Police Paper before us, besides the instructions that have been furnished by the Police. It appears that during investigation, it has come to light that the petitioner, by procuring false documents, got two life insurance policies in the name of one Jugender Singh bearing nos. B6887847 and B8214061, who was already dead in January 2022, whereas the policies were purchased on 17.02.2022 and 26.02.2022, that is Versus Counsel for Petitioner(s) : Beerendra Pratap Singh, Indra Kumar Singh Counsel for Respondent(s) : G.A. Vijay Kumar Singh .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s) to say, after Jugender's death. In the FIR, these facts do figure and it is also said that claims on account of Jugender's death have been brought by one Ruma Devi on both policies. During investigation, the police say that the claim was brought by the petitioner, Vijay Kumar Singh. Learned counsel for the petitioner argues that he was not the one, who brought these claims on the policies purchased in the name of Jugender Singh. It was Ruma Devi. The matter was required to be clarified as to who brought these claims on account of Jugender Singh's death for realising proceeds of the insurance policy. Learned AGA has brought it to our notice that in C.D. No. 19, the statement of the principal accused, Syed Faisal Rahmani has been recorded, who has stated that he had the services of a man Vijay Kumar Singh, son of Shiv Naresh Singh, that is to say, the petitioner, who would get papers prepared for the policies that would be sold in the name of various customers. He said that it was this man Vijay Kumar, who brought documents that were false and bogus, and, it is he, who got the main accused implicated. A role prima facie ascribed to the petitioner is there to an extent that it does not invite interference with the ongoing investigation by this Court. Looking to the enormity of the crime that has been reported in the impugned FIR, we are convinced that the role of officials of the Insurance Company also requires to be deeply probed. Let that be done promptly because so many policies that are all bogus cannot be managed at the level of agents and their henchmen without the involvement of Officials of the Insurance Company. In the totality of circumstances, we do not find this to be a fit case to interfere with the impugned FIR. This writ petition is dismissed. CRLP No. 22497 of 2025 2 Let this order be communicated to the Senior Superintendent of Police, Aligarh and the Station House Officer, Police Station Gandhi Park, District Aligarh through the learned Chief Judicial Magistrate, Aligarh by the Registrar (Compliance) within 72 hours next.
