SREENIVASA REEDY C±iminal Petition No.5919 of 2025 Order: The Criminal Petition, under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the Petitioner/A-3, seeking regular bail, in Crime No.3 of 2025 of Tada Police Station, Tirupathi District. 2. A case has been registered against the petitioner and others for the offences punishable under Sections 8(c) r/w 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 198'5. 3. Case of the prosecution, in brief, is that, o8.01.2025 at 09.15 hours, while police were conducting checking at sri city zero point, Tada Village & Mandal, they found Al and A2 in possession of 28 Kgs of ganja transporting the same in Car bearing No.TN 09 CL 4739, wh'lch was purchased from A-3. Al and A2 were arrested and contraband was seized under the cover of Mahazarnama. 4. Learned counsel for the petitioner submits that the petitioner was shown as Accused No.3 basing on the confessional statement of CO-accused, and the Petitioner has been languishing 1'n jail Since 07.O1.2025- 5. Learned Assistant Public Prosecutor submits that major portion of the investigation has been completed. 2 6. Heard. Perused the record. 7. Basing on.the confessional statement of co-accused, a case has been registered against the petitioner herein and the petitioner herein was not apprehended at the scene of offence. The petitioner was arrested and sent to jud,'cial remand on o7.0112025'and since then he -ls in jail. considering the facts and circumstances of the Court, this Court is inclined to rele'ase the petitioner on bail. 8. Accordingly, the Criminal Petition is allowed. The Petitioner/Accused No.-3 shall be released on bail on executing a personal bond for Rs.10,OOO/-(Rupees Ten Thousand only) with two sureties for the like sum to the satisfaction of the learned Additional Judicial Magistrate of First Class, Sullurupet.
