HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 9690 of 2025 Court No. - 3 HON'BLE SHEKHAR B. SARAF, J. HON'BLE PRASHANT KUMAR, J. 1. Heard Shri Abhishek Shrama, learned counsel appearing on behalf of the petitioner and learned Standing Counsel for the State. 2. This is a writ petition under Article 226 of the Constitution of India, wherein the petitioner is aggrieved by an order dated 13th June, 2025 passed by the office of the Controller Weights and Measures, Uttar Pradesh, Lucknow. Vide the same order, the appeal of the petitioner was disallowed on the ground that by violating Rule 6(10) of the Legal Metrology (Packed Commodities) Rules, 2011, the petitioner had also violated Rules 6(1) of the said Rules. 3. Upon perusal of the said Rules, we are of the view that Rule 6(10) deals with the website that is being run by the petitioner, while Rule 6(1) deals with the actual products that was sold in the market. 4. In light of the same, violation of the Rule 6(10) by itself would not amount to a violation of Rule 6(1), which is the finding of the Controller in the impugned order. 5. In light of the same, we are of the view that the order impugned is required to be quashed and set aside with a direction to the authorities concerned to examine the case of the petitioner once again keeping in mind the distinct features provided in Rule 6(1) and Rule 6(10) Versus Counsel for Petitioner(s) : Akriti Agarwal Counsel for Respondent(s) : C.S.C.
