Neutral Citation No. - 2025:AHC:77105 Court No. - 77 Case :- TRANSFER APPLICATION (CRIMINAL) No. - 105 of 2025 Applicant :- Neelam Opposite Party :- State of U.P. and Another Counsel for Applicant :- Sanjay Kr. Srivastava Counsel for Opposite Party :- G.A. Hon'ble Manoj Bajaj,J. Applicant has filed this application under Section 447 of B.N.S.S., 2023 seeking transfer of Complaint Case No.53 of 2025, titled Smt. Saroj Devi Vs. Rameshwar & others, under Sections 147, 452, 327, 386, 420, 504, 120-B I.P.C., Police Station- Nangal, District Saharanpur, pending in the court of Additional Chief Judicial Magistrate, Deoband, Saharanpur to the competent court of jurisdiction at Meerut. Learned counsel for the applicant submits that the respondent no.2 is the mother-in-law of the applicant, who has falsely implicated her in the subject case, wherein other close relatives are also implicated as accused. He submits that the applicant being a lady is finding it difficult to contest the case at Saharanpur, as she resides at Meerut along with the other accused persons, therefore, learned counsel prays that the case be transferred to Meerut. Concededly, the applicant has not yet joined the trial proceedings, though, she is on bail, as her application U/s 482 Code of Criminal Procedure seeking quashing of the proceedings has been dismissed recently on 22nd May, 2024. The case is nearly ten years old and the other accused persons have not been implicated. Thus, no exceptional ground is made out to transfer the case. Dismissed.
