HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW PUBLIC INTEREST LITIGATION (PIL) No. - 1070 of 2025 Court No. - 1 HON'BLE RAJAN ROY, J.
HON'BLE RAJEEV BHARTI, J.
1. Heard.
2. This petition has been filed as a Public Interest Litigation.
3. On being asked as to the credentials of the petitioner, it was informed by his counsel that he is a resident of the area where some construction work has been undertaken by the Public Works Department. On a perusal of the pleadings, we find that there is a reference to the tender process initiated by the Public Works Department. Some preliminary inquiry etc. is also referred.
4. We wanted to know from the counsel for the petitioner as to what is the source of knowledge of the petitioner in this regard. He could not give any satisfactory reply. The affidavit in support of the writ petition, para 2 thereof says that para nos. 1 to 15 of the writ petition are based on petitioner's own knowledge and belief, but he has not detailed as to from where he acquired such information/knowledge as, obviously, the petitioner is not part of the Public Works Department nor is it the averment that he was involved in the tender process in any manner.
5. The petition appears to be a proxy on behalf of somebody else and we are not satisfied with the credentials of the petitioner. Accordingly, we decline to entertain this PIL. However, our observations will not be Versus Counsel for Petitioner(s) : Saurabh Tripathi, Shobhit Kumar Pandey Counsel for Respondent(s) : C.S.C. Harikesh Kumar .....Petitioner(s) State Of U.P. Thru. Prin. Secy. P.W.D. Lko And 4 Others .....Respondent(s)
understood as validating any illegal act by any person of the Public Works Department and if any proceedings are pending in this regard either before any court or any authority, the same can continue unaffected by our observations.
6. With the aforesaid observations/directions, this petition is dismissed. October 13, 2025 Shravan WPIL No. 1070 of 2025 2 (Rajeev Bharti,J.) (Rajan Roy,J.) Digitally signed by :- SHRAVAN KUMAR High Court of Judicature at Allahabad, Lucknow Bench
