HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CONTEMPT APPLICATION (CIVIL) No. - 4193 of 2025 Court No. - 8 HON'BLE MANISH KUMAR, J. Heard. Present contempt application has been preferred against the alleged non- compliance of the judgment and order dated 24.04.2025 passed in Writ A No. 2213 of 2013. The relevant excerpts of the said judgment and order is being reproduced hereinbelow:- "7. Accordingly, without entering into the merits of the case, respondent no. 2 - Settlement Officer Consolidation, Lakhimpur Kheri is directed to conclude the disciplinary proceedings initiated against petitioner by means of order dated 11.01.2013, with expedition, preferably within eight weeks from the date of production of certified copy of this order, in accordance with law, subject to cooperation of the petitioner." Learned counsel for the applicant has submitted that in compliance of the judgment and order dated 24.04.2025, an order has been passed on 18.07.2025 whereby disciplinary proceedings have been concluded but while passing the said order, it has been mentioned therein that for the payment of dues, a separate order will be passed and this act of respondents is nothing but wilful and intentional disobedience of the judgment and order of the Writ Court, hence, the respondents are liable to be punished under the provisions of Contempt of Courts Act, 1971. After hearing learned counsel for the applicant and going through the record of the case, it is found that Writ Court has only directed the respondents to conclude the disciplinary proceedings initiated against the petitioner, there is no such direction for passing an order for payment of dues in the same order by which the disciplinary proceedings have been concluded, thus, no Versus Counsel for Applicant(s) : Shailendra Singh Chauhan Counsel for Opposite Party(s) : Suresh Chandra .....Applicant(s) Sri Sanjay Kumar Anand Settlement Officer Consolidation Kheri And 2 Others .....Opposite Party(s) contempt is made out against the respondents. In view of the aforesaid, the present contempt application is misconceived, hence, dismissed. December 18, 2025 Ashish CAPL No. 4193 of 2025 2 (Manish Kumar,J.)
